The Really Good Watch Company: Competition Terms & Conditions
THE PROMOTER AND THE T&CS
1. The promoter of all the competitions on our website (“our Website”): reallygoodwatches.com The Really Good Watch Company Limited of 55 Loudoun Rd Loudoun Road, London, England, NW8 0DL (Co. No. 16657060, "The Really Good Watch Company Limited, we, our, us”). Our email address is sales@reallygoodwatches.com ("our Email Address"). The address of the Competition Manager for the purposes of paragraph 3 of Schedule 1 is 6 Lyttelton Road, London, N2 0EF “Paragraph” shall mean a paragraph in the T&Cs.
2. The T&Cs shall apply to all the competitions advertised on Our Website. By submitting a competition entry, you agree to be bound by the T&Cs in force at that time. We may make changes to the T&Cs from time to time, so please check them every time you use Our Website, to ensure you are aware of the T&Cs then current.
THE COMPETITION
3. We run various competitions on our Website from time to time. The details of each competition (“the Competition”) are as described on the relevant Competition page (“Competition Page”) of our Website, which may also state the maximum number of entries we will accept before we close the Competition.
HOW TO ENTER
4. The Competition will be open until the date and time (“the Closing Date”) shown on the Competition Page. Note: the term “Closing Date” will mean the latest date, if extended pursuant to Paragraphs 9.2 and 21.
5. All Competition entries must be received by us by no later than the Closing Date, and any received after the Closing Date will be automatically disqualified.
6. Each Competition entry is represented by unique number (“Entry Number”) for which a payment is to be made (unless the free postal entry route is used) as indicated on the Competition Page. To obtain an Entry Number, there are two available routes:-
EITHER
PAID ONLINE COMPETITION
6.1 you enter the Competition online, via the Competition Page, by paying the stated price per entry, either choosing or, according to your choice being allocated an
Entry Number or Numbers (each one being a separate
transaction between us).
OR
FREE POSTAL COMPETITION
6.2 you enter the Competition for free by complying with Our postal entry requirements fully set out in Schedule 1 below, so that you can be allocated an Entry Number for each postcard received from you (each one being a separate transaction between us). NOTE: Please ensure you have read the T&Cs before entering, as entering the Competition creates a legally-binding contract between us to which the T&Cs apply. We recommend that you print and retain, or save to your device, a copy of the T&Cs for future reference.
7. The winner (“the Winner”) of the Competition, and therefore of the Prize, will be selected from amongst all the chosen or allocated Entry Numbers by a process of random selection. This random selection may be performed by a random number generator (provided by the Google random number generator, www.random.org, or similar technology)
8. Competition entries made via the paid online route are non-refundable, unless We cancel the Competition (as to which see Paragraph 9).
CANCELLATIONS OR EXTENSIONS
9. We may by notice on Our Website:-
9.1 cancel any Competition in the event of a force majeure event, as defined in Schedule 2, but then We will refund all entry fees; or
ELIGIBILITY
10.Our Competitions are open those of or over 18 years of age or over, although we wish to clarify that they are not open to:-
10.1 Our employees, or employees of Our holding or subsidiary companies;
10.2 employees of Our agents or suppliers or their holding or subsidiary companies, who are professionally connected with the Competition or its administration; or
10.3 members of the immediate families or households of any of the above.
11. By entering the Competition, you confirm that you are eligible to enter and to claim any prize you may win AND for these purposes:-
(a) We may require proof of your eligibility;
(b) you accept full responsibility for any entry into a Competition outside of these eligibility requirements and for ensuring that you do not contravene any applicable law;
(c) We do not accept any responsibility for any unlawful Competition entries;
(d) no refund shall be made in respect of any entry found to be ineligible; and
(e) We may conduct age verification procedures to ensure compliance with the law, by which entrants and Winners may be required to provide proper identification (with photo-ID) to verify their identity, age and place of residence.
12. We will not accept any entries that We reasonably believe:-
(a) were automatically generated by computer;
(b) were completed by third parties;
(c) were bulk entries;
(d) are illegible, have been altered, reconstructed, forged or tampered with;
(e) were received after the Closing Date;
(f) cannot be matched to a registered entrant;
(g) to be incomplete; or
(h) part of a series or scheme using multiple names and addresses, in which case all associated entries will be voided (whether by the paid or free entry route). Entries on behalf of another person will not be accepted and joint submissions are not allowed.
13. We accept no responsibility for prospective entrants being unable to connect to Our Website to participate in any Competition due to any technical or other problem relating to an email or web connection. Further, proof of transmission does not amount to proof of receipt.
14. The Competition Page may set out the maximum number of entries per person for that Competition (whether online or via the free postal route).
15. Conduct contrary to the spirit or intention of the Competition may lead to disqualification at our absolute discretion.
16. Payments for Competition entries, and moneys held as a credit balance in a registered entrant’s digital wallet, are non-refundable, but may be applied to a future online Competition entry or entries.
THE PRIZE
17. The Prize will be as described on the Competition Page and, following the draw, the Entry Number winning the Prize will be displayed there, as mentioned in Paragraphs 23.2 and 24.
18. The Prize is neither negotiable nor transferable.
19. We reserve the right to substitute for the Prize a cash prize at least equal to the cash value of the Prize, taking into account any original discounts on price, if:-
20.1 the Prize, or a reasonable alternative to it, becomes unavailable; or
20.2 circumstances beyond Our reasonable control make it necessary for us to do so.
WINNERS
20. Our decision as to all matters where we have a discretion, or where we apply the rules of these T&Cs, is final; and no correspondence or discussion concerning it will be entered into.
21. After the Closing Date, We will:-
21.1 not amend any contact information once registered by us; and
21.2 contact the Winner personally as soon as practicable, at Our discretion either by email, using the email address provided upon registration, or by telephone.
22. Within seven days after the Closing Date, we will publish on the Competition Page the name and county of residence of the Winner and the winning Entry Number and if you the winner of the competition is deemed to agree that the Promoter may use the Winner’s name, image and town or county of residence as part of the announcement of the winner of this competition. You further agree to participate in any reasonable further publicity required by the Promoter.
CLAIMING AND DELIVERY OF THE PRIZE
23. Delivery of the Prize to the Winner may take up to 14 days.
24. Delivery of the Prize will either be in person, or via a courier or delivery service (as determined by us). The cost of delivery is borne by us unless stated otherwise from the outset on the Competition Page. A delivery charge may be made for bespoke delivery requirements of the Winner or for re-deliveries.
25. We will make all reasonable efforts to contact the Winner. If the Winner cannot be contacted or is not available or has not claimed the Prize within 21 days after the Closing Date, We reserve the right to offer the Prize to the next eligible entrant selected from the Entry Numbers allocated before the Closing Date, using the same method as previously mentioned.
26. If the Winner is unable to take up the Prize, or fails to do so within 21 (twenty-one) days after the Winner is announced, the Prize shall then become unavailable to the Winner and We shall have no liability whatsoever to the Winner.
LIMITATION OF LIABILITY
27. So as is permitted by law, we, Our agents or distributors will not in any circumstances be liable to compensate the Winner, or nor have any liability for any loss, damage, personal injury or death occurring, as a result of taking up the Prize, except where it is caused by the negligence of us, Our agents or distributors or that of Our or their employees. Subject to that, your statutory rights are not affected.
OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
28. All Competition entries and any accompanying material submitted to us will become Our property on receipt and will not be returned.
29. By obtaining your Entry Number and submitting any accompanying material, you agree to:-
30.1 assign to us all your intellectual property rights absolutely and with full title guarantee; and
30.2 waive all moral rights in and to your Competition entry, and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988, as amended from time to time, and under all similar legislation from time to time in force, anywhere in the world.
DATA PROTECTION AND PUBLICITY
31. We will process your personal information in accordance with Our Privacy and Cookie Policy and as mentioned above under “Winners”.
(a) if the Winner wishes to unsubscribe from the third party’s email list, they may do so at any time by clicking on the unsubscribe button at the foot of the third party’s email to them, if available, and, if not, by emailing that third party; and
(b) in any event, the Promoter shall have no liability for the acts or omissions of any third-party.
32. By registering with reallygoodewatches.com and details of special offers that may be of interest. You may unsubscribe from this at any time in accordance with Our Privacy & Cookie Policy.
GENERAL
33. If there is any reason to believe that you are or have been a breach of these T&Cs, We may, at Our sole discretion, reserve the right to exclude you from participating in any of Our competitions.
34. Events (including but not limited to events of force majeure) may occur that render the awarding of the Prize impossible due to reasons beyond Our reasonable control and then We may at Our absolute discretion vary, suspend, cancel or amend the Competition, and the entrant agrees that We shall have no liability in such circumstances.
35. For the purposes of the Contracts (Rights of Third Parties) Act 1999 and otherwise Only you and Us (and no other party) may claim that the terms of the contract between us confer a benefit, either expressly or as a matter of contractual construction, on any other party.
36. All non-compliant entries will be deemed void.
37. The Website terms and conditions Also apply Provided That, where the content of Schedule 3 conflicts with the T&Cs, the T&Cs shall prevail.
38. English law shall apply to Our Website and the T&Cs, and the English courts shall have exclusive jurisdiction in relation to any dispute over them.
SCHEDULE 1
POSTAL ENTRY REQUIREMENTS
To enter a Competition by post:-
1. register online, entering:-
1.1 the name of the Competition in which you wish to participate;
1.2 your:-
(a) full name;
(b) date of birth - NOTE: you have to be aged 18 or over on the date on which you post your postcard;
(c) full postal address;
(d) email address; and
(e) telephone number.
2. Send one unenclosed postcard per entry by ordinary first-class or second-class post to us (not exceeding the maximum number per entrant as stated on the Competition Page), stating:-
2.1 the name of the Competition in which you wish to participate;
2.2 your:-
(a) full name;
(b) date of birth - NOTE: you have to be aged 18 or over on the date on which you post your postcard;
(c) full postal address;
(d) email address; and
(e) telephone number.
3. Address the postcard to the Competition Manager, as identified in paragraph 1 of the T&Cs.
4. All details must be either typed or clearly written - NOTE: your entry will be invalid if the writing on your postcard is not legible, in our absolute discretion.
5. Postal entries must be received before the Closing Date and any received after the Closing Date will be automatically disqualified.
6. If you supply your email address, you will receive an email confirming receipt of your postal entry, letting you know that you have been entered into the Competition, together with your Entry Number. All postal entries are treated in the same way as entries using the paid route, and you will have an equal chance of winning the Competition as those who enter online.
7. We will not accept:-
(a) any responsibility for postcard entries that are lost, mislaid, damaged or delayed in transit beyond the Closing Date, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, or systems, satellite, network, server, computer hardware or software failure of any kind; or
(b) proof of posting or transmission as proof of receipt of entry into the Competition.
8. All Competitions will have sufficient tickets reserved for at least four working days commencing on the date on which the Competition goes live (as mentioned on Our Website), to allow time for postal entries to reach us.
9. NOTE: one entry per postcard - multiple entries are restricted as mentioned on Our Website - if We believe one person is attempting to enter using multiple names and addresses, all associated entries will be voided, entries on behalf of another person will not be accepted and joint submissions are not allowed (as with the online paid entry route).
SCHEDULE 2
FORCE MAJEURE EVENTS
Force majeure event means any circumstance not within Our reasonable control including any:-
1. act of God, flood, drought, earthquake or other natural disaster;
2. epidemic or pandemic;
3. terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations;
4. nuclear, chemical or biological contamination or sonic boom;
5. law passed or action taken by a government or public authority, including imposing an export or import restriction, quota or prohibition;
6. collapse of buildings, fire, explosion or accident;
7. interruption or failure of utility service.
